hi there, firstly thankyou to everyone who has answered my other questions regarding this.long story but please bear with me if you can…
basically we are (trying!) to buy a house from a couple who divorced three years ago. our offer was agreed in writing by both parties of the couple as was the contents.and these documents are with our solicitors. the very last completion papers have been signed by us, and the woman of the couple but the man is now refusing to sign. actually stating to my husband (who he keeps constantly ringing) that he hopes we pull out of the sale as he wants to cause the woman as much trouble as he can. i have a feeling hes trying to get us to pull out because he cant.as we have now found out that there is some kind of clause written in the divorce that if one or other of the couple tries to halt the sale of the house the other party of the couple can take them to court and he can be forced to sign by the judge. i think it is called a “forced” sale? the woman has now had to pay £800 to instruct her solicitor to take her ex husband back to court. can anyone please give me any advice (or any hope at all!) of where we stand in this situation ? or has anyone ever come across anything like this before.
we really love this house but are so upset by all this and dont know what to do for the best.our solicitor is struggling because he can never get any answers from the mans solicitors as hes not responding to any letters or phone calls!
any good advice please?
